TERMS OF USE

Welcome to ClamQuest, LLC (“ClamQuest,” “we,” “our,” or “us”). Please read these Terms of Use (“Terms”) carefully before accessing or using our mobile application ClamQuest, website (www.clamquest.com or www.clamquest.app), or related services (collectively, the “Services”). By using or accessing the Services, you agree to be bound by these Terms and all applicable laws.

Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please do not use the Services.

Eligibility and Age Restrictions

ClamQuest is intended for users aged 13 and older. Users under 18 must have parental or guardian approval to use the Services. We do not knowingly collect personal information from children under 13. Parents and guardians are encouraged to supervise their child’s use of the Services.

Permitted Use

You may use the Services solely for your personal, non-commercial enjoyment and in compliance with these Terms and all applicable laws. You agree not to:

• Violate any laws or regulations;

• Upload or distribute viruses, malware, or harmful content;

• Infringe intellectual property or privacy rights;

• Use the Services for unauthorized commercial purposes;

• Impersonate others or engage in abusive or harassing behavior;

• Interfere with or disrupt the operation of the Services.

User Content

Some features may allow you to submit content (“User Content”). You retain ownership of your User Content but grant ClamQuest a non-exclusive license to use, display, and distribute it as necessary to provide the Services. You are solely responsible for your User Content.
ClamQuest does not endorse User Content and is not responsible for its accuracy or legality. We reserve the right to remove any User Content at our discretion.

Account Responsibility

You must be 13 or older to create an account. You are responsible for maintaining the confidentiality of your account and all activities under it. Notify us immediately of any unauthorized use.
Account sharing is limited to family members. You may not share or use accounts beyond this scope.

Termination

We may suspend or terminate your access to the Services at any time, without notice or liability, for any reason including violation of these Terms.

Privacy

Your use of the Services is subject to our Privacy Policy. Please review it carefully.

Disclaimers and Limitation of Liability

The Services and content are provided “as is,” without warranties of any kind. ClamQuest disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
We are not liable for any damages arising from your use of the Services, including errors, interruptions, or third-party content. Some jurisdictions may not allow limitations on liability, so this may not apply to you.

Indemnification

You agree to indemnify and hold harmless ClamQuest, its affiliates, officers, and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

In-App Purchases

Non-Consumable Purchases Certain features or upgrades may be available as one-time non-consumable purchases, which are permanently unlocked and do not expire. These purchases are tied to your Apple ID and can be restored on any device signed in to the same Apple ID at no additional charge using the "Restore Purchases" function within the app.

Consumable Purchases Certain items may be available as consumable purchases, which are used once and are not restored or transferable. Consumable purchases are not eligible for refund once redeemed.

General All purchases are processed exclusively by Apple and are subject to Apple's Terms of Sale and Privacy Policy. ClamQuest, LLC does not collect or store any payment or billing information. All refund requests must be submitted directly to Apple. ClamQuest, LLC has no authority to issue refunds for purchases made through the App Store.

Prices are displayed in your local currency and may vary by region. ClamQuest, LLC reserves the right to change pricing or discontinue purchase options at any time. Changes will not affect purchases already completed.

Third-Party Services and Links

The Services may contain links or integrations with third-party services. We do not control or endorse third-party content or practices and disclaim liability related to those services.

Export Control

Use of the Services is subject to U.S. export laws. You agree not to download or export the Services to prohibited countries or individuals.

Updates to Terms

We may update these Terms at any time by posting the revised version with a new effective date on our website or in the app. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in Florida.
